ASA Rule on Club La Costa Prize Promotion

The Advertising Standards Authority (ASA) have upheld a complaint made about prize promotions from Premier Data Logistics Ltd and Club La Costa – the people behind the 2minute Draw. The ruling supported the complaint by someone who had been “awarded” a holiday and who felt mislead because the “award” was strikingly similar to the prize on offer. This made them also think the closing date quoted on the leaflet wasn’t genuine.

Significant Condition Of Attendance

ASA ruled that “the ad did not make the difference between the gift holiday with conditions attached that was offered to entrants on completion of the survey and the prize draw holiday to be awarded after the August closing date sufficiently clear”. “Because of this, and because the ad did not make clear that the gift holiday offered to entrants was attached to the significant condition of attendance at presentations regarding time-share facilities” they concluded the ad could mislead.

The Prize Draw Was Genuine

However, ASA also ruled that they were happy with the closing date issue and that the prize draw was genuine. Both PDL and Club La Costa have been told by ASA to make sure that there are differences between prizes on offer and gifts awarded to participants.
